NOTICE OF INTENT<\/em><\/strong><\/p>\n

\u00a0<\/em><\/strong><\/p>\n

SOCIETATEA NATIONALA NUCLEARELECTRICA S.A. (\u201cSNN\u201d) <\/em><\/strong>is the sole nuclear power producer as well as the only manufacturer of CANDU 6-type nuclear fuel in Romania. SNN is a national company incorporated in 1998 currently having the following shareholder structure: the Romanian State represented by the Ministry of Energy (82.4981%) and other individuals and legal persons (17.5019%). SNN is listed on the Bucharest Stock Exchange since 2013.<\/em><\/p>\n

The company has the registered office in Bucharest and has two branches:<\/em><\/p>\n

– <\/em>Cernavoda Nuclear Power Plant Branch<\/em><\/strong> operating Units 1 and 2 producing electrical and thermal energy. Units 1 and 2 are CANDU-type units (CAN<\/strong>ada D<\/strong>euterium U<\/strong>ranium) with an installed capacity of about. 700 MWe each, using natural uranium as fuel and heavy water as moderator and cooling agent.<\/em><\/p>\n

– <\/em>Pitesti Nuclear Fuel Plant Branch <\/em><\/strong>is a qualified manufacturer of CANDU 6 type nuclear fuel and fully covers the operating necessities of Units 1 and 2 of Cernavoda NPP.<\/em><\/p>\n

With two operating units, SNN SA ensures approximately 20% of the domestic consumption of Romania.<\/strong><\/em><\/p>\n

The nuclear fuel necessary for the operation of Units 1 and 2 of Cernavoda NPP is manufactured within the Nuclear Fuel Plant Branch (FCN) Pitesti. <\/em><\/p>\n

In the aforementioned context, SNN is launching by present Notice of intent an evaluation process to select potential suppliers of U3O8 (Natural Uranium Concentrate) with a uranium content of at least 65%.<\/em><\/strong><\/p>\n

 <\/p>\n\n\n\n
In cadrul procesului de evaluare vor avea posibilitatea sa participe toti potentialii furnizori de concentrat de uraniu natural, daca sunt interesati sa participe la procedurile de achizitie sectoriala initiate de SNN in baza Legii 99\/2016.<\/p>\n

Conditii :<\/em><\/strong><\/p>\n

1) Evaluarea pentru selectarea potentialilor furnizori se realizeaza in conformitate cu prevederile Legii nr. 111\/1996 privind desfasurarea in siguranta, reglementarea, autorizarea si controlul activitatilor nucleare republicata, cu modificarile si completarile ulterioare si ale Normelor CNCAN: NMC-06 privind cerin\u0163ele specifice pentru sistemele de management al calit\u0103\u0163ii aplicate activit\u0103\u0163ilor de aprovizionare destinate instala\u0163iilor nucleare, aprobate prin Ordinul nr. 70\/2003 modificat si completat cu Ordinul Nr. 236\/15 decembrie 2014 si NMC-13 pentru stabilirea claselor de aplicare gradata a cerintelor sistemelor de management a calitatii de fabricare aproduselor si realizarea serviciilor destinate instalatiilor nucleare aprobate prin Ordinul Nr. 407\/ 29.11.2004.<\/p>\n

2) Concentratul de Uraniu natural trebuie sa indeplineasca cerintele tehnice din Specificatia de Procurare S.P.-1.03 ed.4 \u201eU3O8 (Concentrat de Uraniu natural) cu continut de uraniu de minim 65%<\/em>\u201d<\/p>\n

3) Activitatile ce vor compune procesul de evaluare si selectare a potentialilor furnizori de U3<\/sub>O8<\/sub> (concentrat de uraniu natural) cu con\u021binut de uraniu de minim 65% se vor desf\u0103\u0219ura in conformitate cu documentul Planificarea ac\u021biunilor de calificare ini\u021bial\u0103, cod DDESM \u2013 433\/08.02.2022<\/em>;<\/p>\n

4) Procesul de evaluare a potentialilor furnizori incepe prin transmiterea la sediul CNU SA Sucursala Feldioara (Strada Dumbr\u0103vii 1, Feldioara, jud. Brasov, Romania) o proba a produsului ce face obiectul evaluarii. Cantitatea minima a probei de concentrat de uraniu natural pentru efectuarea testelor si analizelor fizico-chimice este de 3 kg de Uraniu natural in U3O8 (Concentrat de Uraniu natural).<\/strong> Costul aferent cantitatii de produs transmisa in vederea testarii, precum si toate costurile asociate vor fi suportate de potentialul furnizor, in conditiile precizate mai jos.<\/strong><\/p>\n

5)Testarea probelor de produs transmise \u00een vederea evaluarii, se va efectua de c\u0103tre CNU Sucursala Feldioara, la sediul acestuia, conform Planului de testare a concentratelor de uraniu cod DAQ 89\/24.11.2020<\/em>. Durata estimata a evaluarii este de 30 de zile calendaristice de la sosirea probei la sediul CNU SA Sucursala Feldioara, Strada Dumbr\u0103vii 1, Feldioara, jud. Brasov, Romania.<\/p>\n

6) Cantitatea de la pct. 4 de mai sus va fi livrata in conditia de livrare DDP CNU Sucursala Feldioara, Brasov, Romania, conform INCOTERMS 2020.<\/p>\n

Furnizorii vor avea obligatia sa suporte toate costurile asociate transportului, asigurarii, obtinerii autorizatiei de export\/transfer intracomunitar (dupa caz) etc., iar SNN va suporta costurile obtinerii autorizatiei de import si a celor asociate testarii probei de produs;<\/p>\n

7) Probele vor fi \u00eenso\u021bite de urm\u0103toarele documente:<\/p>\n

a.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Buletine de control care sa demonstreze conformitatea produsului cu cerin\u021bele din S.P.-1.03 \u201eU3O8 (concentrat de uraniu natural) cu con\u021binut de uraniu de minim 65%<\/em>\u201d;<\/p>\n

b.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Autoriza\u021bie de export\/transfer intracomunitar (dup\u0103 caz) eliberata de organismul de reglementare din tara de rezidenta a fabricantului;<\/p>\n

c.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Datele privind identitatea probei de \u201eU3O8 (concentrat de uraniu natural) cu con\u021binut de uraniu de minim 65%\u201d, dup\u0103 cum urmeaz\u0103:<\/p>\n

– Numele fabricantului<\/p>\n

– Tara de origine a materialului<\/p>\n

– Denumirea materialului con\u021binut \u00een proba<\/p>\n

– Num\u0103rul lotului<\/p>\n

– Num\u0103r recipient\/proba<\/p>\n

– Masa bruta\/masa neta\/tara (toate \u00een kg cu o zecimal\u0103)<\/p>\n

– Con\u021binut\/concentra\u021bie U (\u00een % cu dou\u0103 zecimale)<\/p>\n

– Masa de uraniu (\u00een kg cu trei zecimale)<\/p>\n

– Data ambal\u0103rii<\/p>\n

d.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Fi\u0219a cu date de securitate conform regulamentului (CE) nr. 1907\/2006 (REACH); dac\u0103 FDS nu con\u021bine num\u0103rul de \u00eenregistrare REACH, furnizorul va transmite o declara\u021bie pe propria raspundere \u00een care va men\u021biona motivul pentru care produsul nu a fost \u00eenregistrat;<\/p>\n

e) Formularul AC-295 C \u201eRaport de prezentare furnizor\u201d, completat \u015fi semnat de c\u0103tre fabricantul declarat;<\/p>\n

f) Declara\u021bia fabricantului prin care acesta accept\u0103 ac\u021biunile care urmeaz\u0103 s\u0103 fie \u00eentreprinse de c\u0103tre achizitor \u00een vederea evalu\u0103rii pentru selectare ca posibil furnizor de U3O8 pentru SNN;<\/p>\n

8)Opera\u021biile de ambalare, containerizare, marcare, etichetare, manipulare, depozitare, transport, intr\u0103 \u00een sarcina furnizorului \u015fi trebuie s\u0103 asigure respectarea cerin\u021belor na\u021bionale \u015fi interna\u021bionale aplicabile pentru materiale radioactive, incluse in Clasa 7 \u2013 Materiale radioactive (UN 2909, UN 2910, UN 2912) conform Acordului referitor la transportul interna\u021bional rutier al m\u0103rfurilor periculoase (ADR).<\/p>\n

9) Cerinte de administrare\u00a0:<\/p>\n

a)\u00a0\u00a0\u00a0\u00a0 SNN, Sucursala FCN Pitesti va pune la dispozi\u021bia potentialului furnizor, in maximum 5 zile lucr\u0103toare de la solicitare, toate documentele legale necesare pentru ob\u021binerea autorizatiei de export \/ transfer intracomunitar (dupa caz) si a altor licen\u021be\/autoriza\u021bii\/aprob\u0103ri necesare;<\/p>\n

b)\u00a0\u00a0\u00a0\u00a0 Furnizorul va pune la dispozi\u021bia SNN, Sucursala FCN Pite\u0219ti, cu minim 40 de zile \u00eenainte de livrarea probei, cel pu\u021bin urm\u0103toarele informa\u021bii\/documente necesare pentru ob\u021binerea autoriza\u021biei de import\/ transfer intracomunitar (dup\u0103 caz) si a altor licen\u021be\/ autoriza\u021bii\/ aprob\u0103ri necesare:<\/p>\n

1\u02da. \u00a0Date privind produc\u0103torul materialului<\/p>\n

2\u02da. \u00a0Tara de origine a materialului;<\/p>\n

3\u02da. \u00a0Date privind modul de efectuare a transportului de la produc\u0103tor la CNU Sucursala Feldioara (ex.: terestru-maritim\/aerian-terestru etc.);<\/p>\n

4\u02da. \u00a0Date privind transportatorul autorizat de CNCAN care va efectua transportul materialului pe teritoriul Rom\u00e2niei;<\/p>\n

5\u02da. \u00a0Copia Autoriza\u021biei de transport emisa de CNCAN pentru transportul pe teritoriul Rom\u00e2niei (in conformitate cu Legea 111\/1996 si NTR-01);<\/p>\n

6\u02da. \u00a0Date privind materialul transportat: denumire, cod UN, codul lotului de material, con\u021binut de uraniu (in % cu doua zecimale), date privind cantitatea de material (masa bruta\/ tara\/ masa neta \u2013 in Kg cu o zecimala, cantitatea de uraniu \u2013 in Kg cu trei zecimale);<\/p>\n

c)\u00a0\u00a0\u00a0\u00a0 Furnizorul va pune la dispozi\u021bia SNN, Sucursala FCN Pitesti, in maximum 5 zile lucr\u0103toare de la solicitare, alte informa\u021bii\/documente dec\u00e2t cele prev\u0103zute la pct. 9) b) de mai sus, daca vor fi necesare in scopul obtinerii de catre SNN autoriza\u021biei de import\/ transfer intracomunitar (dup\u0103 caz) si a altor licen\u021be\/ autoriza\u021bii\/ aprob\u0103ri de la autoritatile de reglementare din Romania.<\/p>\n

Toate documentele si informatiile necesare participarii la etapa de evaluare vor fi puse, fara costuri, la dispozitia furnizorilor care isi vor exprima interesul. Solicitarea in acest sens se va transmite la <\/em><\/strong>fcn@nuclearelectrica.ro<\/em><\/strong><\/a>; <\/em><\/strong>dana.costea@nuclearelectrica.ro<\/em><\/strong><\/a>; \u00a0<\/em><\/strong>emil.macovei@nuclearelectrica.ro<\/em><\/strong><\/a>;<\/em><\/strong><\/p>\n

andrei.musetoiu@nuclearelectrica.ro<\/em><\/strong><\/a>; <\/em><\/strong><\/td>\n

During the process of evaluation all suppliers of natural uranium concentrate shall have the possibility to participate, if interested, to participate in the acquisition procedures that will be launched by SNN in accordance with the provisions of Law 99\/2016.<\/p>\n

Conditions:<\/em><\/strong><\/p>\n

1) The suppliers are evaluated to select potential suppliers in accordance with the provisions of Law no. 111\/1996 on the safe deployment, regulation, authorization and control of the nuclear activities, republished, with the subsequent modifications and additions and of the CNCAN: NMC-06 Norm regarding specific requirements for quality management systems applied to supply activities destinated to nuclear installations, approved by Order No. 70\/2003 modified and completed with Order No. 236\/2014, December 15,\u00a0 and NMC-13 for establishing the graded approach of the quality management systems requirements for product manufacturing and services destinated to nuclear installations, approved by Order No. 407\/ 2004, November 29;<\/p>\n

2) Natural uranium ore concentrate must comply with the technical requirements of the Procurement Specification S.P.-1.03 issue 4 \u201cU3O8 (Natural uranium ore concentrate) with a minimum uranium content of 65%\u201d<\/em><\/p>\n

3) The activities of the process of evaluation to select potential suppliers of U3<\/sub>O8<\/sub> (natural uranium ore concentrate) with a minimum content of uranium of 65% shall be performed according to document Planning of initial qualification actions, code DDESM \u2013 433\/08.02.2022;<\/em><\/p>\n

4) The process of evaluation of potential suppliers, shall begin with the bidders sending to the Processor\u2019s establishment, CNU SA Feldioara subsidiary (Dumbr\u0103vii Street 1, Feldioara, Brasov District, Romania) a sample of the offered product that will be evaluated. The minimum quantity of the natural uranium concentrate sample necessary for performing the testing plan is 3 kg of natural Uranium as U3O8 (Natural uranium ore concentrate). <\/strong>The costs of the sample quantity that will be send for testing and all the associated costs will be borne by the potential supplier, under the conditions mentioned below.<\/p>\n

5) Testing of product samples submitted by bidders for evaluation, shall be performed by the CNU Feldioara, on\u00a0\u00a0 its own premises according to the Testing Plan DAQ 89 \/ 24.11.2020.<\/em> The estimated period for evaluation is of 30 calendar days since the arrival of the sample at CNU SA Feldioara Subsidiary, Dumbr\u0103vii Street 1, Feldioara, Brasov District, Romania.<\/p>\n

6) The quantity mentioned at item 4 above shall be delivered DDP Feldioara – Brasov, Romania, according to INCOTERMS 2020.<\/p>\n

The suppliers shall undertake to bear all costs associated to the transportation, insurance, obtaining the export license\/intracommunity transfer license (as applicable) etc., and SNN shall bear the cost for obtaining the import authorization and costs of the testing procedure of the sample;<\/p>\n

7) \u00a0Samples will be accompanied by the following documents:<\/p>\n

a.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Inspection bulletins to prove the compliance of the sample with the requirements of\u00a0 S.P.-1.03, “U3O8 (Natural Uranium Ore Concentrate) with a minimum content of uranium of 65%”;<\/em><\/p>\n

b. Export\/ intracommunity transfer license (where appropriate) issued by the regulatory body of the country of origin of the supplier;<\/p>\n

c.\u00a0 Information regarding the identity of the sample of U3O8 (Natural Uranium Ore Concentrate) with a minimum content of uranium of 65%, as follows:<\/p>\n

-Name of manufacturer<\/p>\n

-Country of origin of the material<\/p>\n

-Name of material inside the sample<\/p>\n

-Number of lot<\/p>\n

-Container number\/sample<\/p>\n

-Gross weight\/ tare\/ net weight (all in kilograms with one decimal)<\/p>\n

-Content \/ concentration of U (in % with two decimals)<\/p>\n

-Uranium mass (in kilograms with three decimals)<\/p>\n

-Date of packing<\/p>\n

d. Material Safety data sheet according to Regulation (EC) No. 1907\/2006 (REACH); if the MSDS does not contain the REACH registration number, the Supplier will send a statement on his own responsibility stating the reason for which the product was not registered;<\/p>\n

e) Form code AC-295C “Supplier presentation report” completed and signed by the declared manufacturer;<\/p>\n

f) The manufacturer’s declaration accepting the actions to be taken by the purchaser for evaluation to select as potential U3O8 supplier for SNN;<\/p>\n

8) Packaging operations, containerization, labeling, transportation, storage, handling is the responsibility of the bidder and must ensure compliance with the applicable national and international requirements for radioactive materials included in Class 7 (UN 2909, UN 2910, UN 2912) according to European Agreement regarding international road transport of dangerous goods (ADR).<\/p>\n

9) Administration requirements:<\/p>\n

a)\u00a0\u00a0\u00a0\u00a0 SNN, FCN Pitesti Subsidiary will make available to the potential supplier, within a maximum of 5 working days from the request, all the legal documents necessary to obtain the export license\/intracommunity transfer license (as applicable) and other necessary licenses \/ authorizations \/ approvals;<\/p>\n

b)\u00a0\u00a0\u00a0\u00a0 The supplier shall make available to SNN, FCN Pitesti Subsidiary, at least 40 days before delivery, at least the following information \/ documents required to obtain the import \/ intra-Community transfer license (as applicable) and other necessary licenses \/ authorizations \/ approvals:<\/p>\n

1\u02da. Material manufacturer data<\/p>\n

2\u02da. Country of origin of the material;<\/p>\n

3\u02da. Data on how to perform the transport from producer to CNU Feldioara Conversion Plant (eg: land-sea \/ air-land etc.);<\/p>\n

4\u02da. Data regarding the authorized carrier by CNCAN that will transport the material on the Romanian territory;<\/p>\n

5\u02da. Copy of the Transport Authorization issued by CNCAN for the transport on the Romanian territory (in accordance with Law 111\/1996 and NTR-01);<\/p>\n

6\u02da. Data regarding the transported material: description, UN code, material batch code, uranium content (in% to two decimal places), data on the quantity of material (gross weight \/ tare \/ net weight – in Kg to one decimal place, quantity of uranium – in Kg with three decimal places);<\/p>\n

c) The supplier will make available to SNN, FCN Pitesti Subsidiary, within a maximum 5 working days from the request, other information \/ documents than those provided above at 9) b) point, if they are necessary for obtaining by SNN of the import \/ intra-Community transfer license (as applicable) and other necessary licenses \/ authorizations \/ approvals from the Romanian competent authorities.<\/p>\n

All necessary documents and information for participating to the evaluation phase shall be provided, free of charge, for the interested suppliers.
